Areas of Practice

IP Litigation

Whether you have been threatened with a lawsuit or whether you need to consider litigation to assert your rights, I will provide the carefully tailored personal attention your matter deserves, along with nearly two decades of experience. Throughout my career I have handled all stages of IP disputes, from pre-filing investigations through expert discovery, trials, and appeals. My clients include angel-stage startups, Fortune 500 companies, and multinational tech companies.  This experience has uniquely prepared me to efficiently find a solution that furthers your business goals.

Technology Diligence

I also have experience analyzing IP portfolios, both to identify valuable assets in an assertion context, and to evaluate risk in a defensive context. This has included conducting targeted validity and infringement analysis in line with each project’s goals. In my experience, each IP / technology diligence project must be customized to the client’s specific needs to ensure a useful work product within budget and on time. I offer the dedicated attention and deep technology knowledge needed to efficiently meet these requirements.

My specific areas of expertise include:

  • Computer Hardware, such as high speed signalling (HDMI and USB, including PHY layer); WiFi 6; memory chips; and hard drive components.

  • Computer Software, including databases, network address translation; packet analysis for network security; and mobile device security.

  • Life Sciences, including non-invasive prenatal genetic testing; software-guided native human antibody discovery; and massively-parallel small molecule drug discovery.

  • Solar Energy, from PV cell deposition techniques to cell texturing and anti-reflective coating to balance of system components such as rooftop mounting technologies.

Appeals

Appeals are an inevitable part of IP litigation and other complex cases. Throughout my career I have briefed, argued, and won appeals in federal and California state appellate courts. In fighting appeals, I think strategically to avoid re-arguing the entire lawsuit, instead identifying targeted weak points in the opponent’s case that my client can likely win on appeal. I accompany this by patiently and persistently drilling down into the record for facts that will support our case. When necessary, I call on my engineering background and high tech experience to analyze and describe complex technical points in ways a panel of judges can understand.
